Dear Director Runkle:

Please be advised that I am in receipt of your letter of October 18, 2001, concerning the health and living conditions of chickens at the Buckeye Egg Farm at Harpster, Ohio.

Based upon our review of your materials and the appropriate Ohio Revised Code Statute sections, it is our opinion that only misdemeanor offenses apply to the facts presented to us. Misdemeanor charges on any of these violations would not be handled by the Wyandot County Prosecutor. Therefore, we have referred all of this information to the Municipal Court Prosecutor, Richard A. Grafmiller, for his consideration.

Thank you for providing this information, and we agree that there needs to be an immediate investigation and that is why we processed and reviewed this matter very quickly for the appropriate determination of how it should be handled what Prosecutor should be contacted.
